The general guideline is that if you can enter France or the EU without a visa then you’re alright on the french side of the island (St. Martin). But, in practice, there are no real checks or enforcement happening. However it is still illegal for you to be there and you will definitely not be able to leave from that side since they won’t give you an exit stamp (which is what almost happened to me).

So for your friend who is a resident of Estonia, he should be fine to take the public ferry, and also your Canadian friend.

But for you, unless you have a french visa for St Martin, I would recommend that you take the private ferry from Marigot.

Thanks for all the information. I had a couple of questions. I am a Canadian permanent resident, travelling to sint maarten and then to Anguilla with a couple of friends. One of my friends has a Canadian passport and the other, like me, an Indian passport who is also a Canadian permanent resident. He also has a blue card, resident of Estonia. Now the question I have is that, can I take the ferry from Marigot to Anguilla, or should I do it from the Dutch side. Also, is it illegal for me to be on the French side of the island or not.

How confusing! You are lucky that you were able to leave! Possibly the reason the island stays so pristine and beautiful is because they hardly let anyone in!
